Access and Use

This User Agreement with Dublin City Council and the Office of the Director of Community and Enterprise ("we"/"us") sets out the terms on which the user ("you") can access and use the bulletin boards hosted by us on the "the dublin.ie" web site (the "Services").

General

Your use of the Services shall be deemed to constitute your agreement and acceptance of the terms and conditions set out in this User Agreement. You may use the Services for your own private use, but not for any commercial or unlawful purpose. The Services are made available to you free of charge, but you acknowledge that we may at any time without notice withdraw the Services or your access to them. These terms may be varied from time to time. The revised term will be posted on the Services and by continuing to use the Services you will be considered to have accepted them.

User Responsibility

The Services allow written communication to a wide number of people and you are encouraged to use good judgement and to think before you transmit or "post" material to the Services.

YOU ACKNOWLEDGE THAT YOU ARE RESPONSIBLE FOR THE CONTENT OF ANY MATERIAL YOU POST TO THE SERVICES. YOU AGREE NOT: TO POST DEFAMATORY, OBSCENE OR OFFENSIVE MATERIAL; TO POST COMPUTER VIRUSES OR ENGAGE IN COMPUTER MISUSE; TO IMPERSONATE OTHERS OR TO OTHERWISE USE THE SERVICES IN ANY WAY WHICH IS OR MAY BE UNLAWFUL OR LIKELY TO CAUSE DISTRESS, OFFENCE OR ANNOYANCE TO OTHER USERS, US OR THIRD PARTIES. YOU AGREE NOT TO USE THE SERVICES SO AS TO INFRINGE THE INTELLECTUAL PROPERTY RIGHTS (EG. COPYRIGHT, TRADE MARKS ETC.) OF ANY OTHER PERSON OR THIRD PARTY. YOU AGREE THAT IF ANY OF THE ABOVE SHOULD OCCUR, YOU WILL INDEMNIFY US FOR ANY AND ALL LOSSES WE SUFFER. BY POSTING MATERIAL TO THE SERVICES YOU ARE DEEMED TO AUTOMATICALLY GRANT, OR WARRANT THAT THE OWNER OF THE RIGHTS IN THE MATERIAL HAS EXPRESSLY GRANTED TO US A ROYALTY-FREE, PERPETUAL, WORLDWIDE, IRREVOCABLE LICENCE TO DO ALL SUCH ACTS WITH THE MATERIAL AS THE OWNER OF THE RIGHTS IN THE MATERIAL MAY DO.

Our Responsibility

You agree that our duty is limited to exercising the reasonable care and skill of a competent free-access web site operator. We do not give any other warranty as to the Services or the material available on them and you agree that, to the full extent permissible by law, we shall not be liable to you for any damages or losses arising in connection with the Services. You accept that it is your responsibility to check the accuracy and completeness of any material on the Services and that we will have no liability to you for any reliance you place on that material.

Monitoring

The Services are designed for communication and discussion. The Services are operated with web managers, who will not edit material prior to its appearance on-screen but will reject any material deemed inappropriate. Services will be supervised and monitored continuously. If you think other users of the Services are breaching these terms please inform us identifying the offending user and detailing the offending material. We shall be entitled, but shall be under no obligation, to remove any material at any time at our sole discretion.

Governing Law

This Agreement is deemed to have been made in Ireland and is governed by Irish law. It is agreed that any dispute relating to this Agreement shall be referred solely to the Irish Courts.

Security

Your registration is for your own use only. You agree to keep your user name and password confidential and not to allow any other person to access or use the Services. This Agreement is personal to you and you cannot pass your rights and obligations on to anyone else.

Code of Conduct

The Office of the Director of Community and Enterprise is committed to making its community network as friendly, easy to use and above all as useful as possible to the people who use it.

That's why we need our users to agree to our Code of Conduct.

This commitment applies to all aspects of the web-site, from creating sites for organisations to members leaving messages or creating discussions on the bulletin board. Remember that each user is responsible for anything he or she uploads to the site or posts to a bulletin board.

Dublin City Council, which runs the dublin.ie web-site, is not responsible for any content on pages created by community members or for bulletin board topics or messages posted to the site.

Look after your own privacy:

Please remember that information on the dublin.ie web-site is visible to anyone who accesses the site. We therefore advise you against giving out personally identifiable information (credit card numbers, names and addresses, etc) to other users.

Be polite:

Remember that people of all ages, races and beliefs may be using the site, so it is important to be polite when communicating with other users and to treat everyone with mutual respect. This is especially important when leaving messages on the bulletin boards.

The Code of Conduct forbids users to:

  • Harass, stalk, abuse or insult any other community user.
  • Make reference to another user in a racist or bigoted manner.
  • Incite others to violate the Code of Conduct.
  • Falsely impersonate anyone from Dublin City Council or The Office of the Director of Community and Enterprise with the intent to mislead others.
  • Post information or details that invade the privacy of others.
  • Remember that you are responsible for anything you upload to the site or post to a bulletin board. Web managers of Dublin City Council have the absolute right to eject or ban users and remove messages that violate the Code of Conduct.
  • Upload words, pictures or any other material or information that is illegal, indecent, dishonest, untruthful, defamatory or obscene.
  • Use their pages to link to any other Internet web-site that contains any of the above material
  • Advertising any business or service on the bulletin board
  • Repeatedly posting the same message in a single discussion
  • Using the space provided in bulletin boards to buy, sell or license any product or for any betting purpose.

Stay legal:

The Office of the Director of Community and Enterprise does not allow any illegal activity within its pages and forbids users from using the site to distribute any material inappropriate for a web-site aimed at the community.

Don't Spam:

The Office of the Director of Community and Enterprise has the absolute right to ban users who persistently "spam" bulletin boards with irrelevant messages or post the same message to several separate discussions.
